Terms and Conditions of Service
Effective Date: February 1, 2025
Welcome to Expediting Legal Services, LLC! We are committed to providing professional and efficient process serving services to meet your legal needs. By engaging with our services, you agree to the following Terms and Conditions. Please read them carefully.
1. Scope of Services
At Expediting Legal Services, LLC, we provide professional process serving services to clients across Mississippi, with a particular focus on Hinds, Madison, and Rankin counties. Our services include but are not limited to the delivery of legal documents to individuals and entities as required by law.
While we make every effort to serve documents quickly and accurately, we cannot guarantee the success of the service. There may be unforeseen circumstances, such as the recipient being evasive or unavailable, which could prevent successful service. We will always use our best judgment and due diligence to locate and serve the intended recipient.
2. No Guarantees of Service Completion
While we make every effort to successfully complete each service request, we do not guarantee the successful service of documents. There are many variables at play that are beyond our control, including but not limited to:
- The recipient's refusal to accept service
- Difficulty in locating the recipient
- Inaccurate or incomplete information provided by the client
We will, however, continue to pursue all reasonable efforts to complete the service and will keep you informed of any developments or difficulties along the way.
3. Refund Policy
Once we begin work on a case and make an attempt to serve documents, no refunds will be issued. This includes situations where service is unsuccessful, and regardless of whether the recipient was located or not.
4. Additional Fees
Unforeseen circumstances may result in additional fees being incurred, such as:
- Mileage Fees for services outside of the local service area
- Printing Fees for documents exceeding 20 pages
- Skip Tracing Fees if additional efforts are required to locate the recipient
-Additional Service Attempts if the recipient is evasive or cannot be located on the first attempt
We make every effort to be transparent about these fees upfront. If additional charges are required for your case, we will contact you for approval before proceeding with any actions that would incur extra costs. We believe in maintaining clear communication and will always seek your approval before taking steps that will affect the final bill.
5. Documentation of Service Attempts
Every attempt to serve legal documents will be documented with either photographic evidence or body cam footage (when applicable). While these records are made to help support the service process, we cannot guarantee that this evidence will be accepted as indisputable proof in court if the service is contested. The quality and content of such evidence may vary depending on the situation, but we will always aim to document the service attempt to the best of our ability.
6. Skip Tracing
If skip tracing is required to locate a recipient, we will make every effort to find accurate and up-to-date information. However, we cannot guarantee the accuracy of information obtained through skip tracing. The success of skip tracing is dependent on the availability of reliable data, and in some cases, we may be unable to locate the individual based on the information provided.
7. Client Responsibilities
To ensure timely and successful service, clients are responsible for:
- Providing accurate and complete information about the individual being served, including their full name, last known address, and any additional details that may assist in locating them.
- Communicating any time-sensitive information or deadlines related to the service.
- Reviewing and approving fees or additional charges before we proceed with services beyond the standard scope.
If the information provided is inaccurate or incomplete, this may delay the service and could result in additional fees.
8. Confidentiality
We are committed to maintaining the confidentiality of your case and any sensitive information you provide. All documentation and communication will be handled in accordance with applicable privacy laws and regulations. However, we cannot guarantee absolute confidentiality if the service is contested in court.
9. Indemnity and Liability
You agree to indemnify and hold harmless *Expediting Legal Services, LLC* and its employees from any claims, damages, or liabilities arising from the service of process. While we take great care in carrying out our duties, we are not responsible for any adverse consequences that result from issues outside of our control, such as the inability to locate or serve the recipient.
10. Compliance with Laws
All services provided by *Expediting Legal Services, LLC* will be conducted in accordance with Mississippi state law and all applicable federal regulations. We maintain the right to refuse services if it would be unlawful or unethical to proceed with the request.
11. Changes to Terms and Conditions
We reserve the right to update or modify these Terms and Conditions at any time. Any changes will be posted on our website, and the updated terms will apply to all services provided after the change is made.
